11. Disclaimers
Minarium provides its Services on an "as is" and "as available" basis. We do not guarantee uninterrupted access or the accuracy of listings.
We are not responsible for:
- Disputes between creators and buyers.
- Losses due to unauthorized access to your account.
- Print quality or delivery issues (though we assist in dispute resolution).
12. Limitation of Liability
To the maximum extent permitted by law, Minarium is not liable for:
- Indirect, incidental, or consequential damages.
- Lost profits or business opportunities.
- Issues beyond our reasonable control.
13. Indemnity
You agree to indemnify and hold Minarium harmless from claims, damages, and expenses arising from your use of the Services or your violation of these Terms.
14. Governing Law & Dispute Resolution
These Terms are governed by the laws of Iowa, USA.
Any disputes will be resolved:
- First, through good-faith negotiations.
- If unresolved, via arbitration in Iowa, USA.
15. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with the effective date.
Continued use of Minarium after updates means you accept the revised Terms.
16. The Vault (Private Digital Asset Library)
The Vault is a private digital asset library for tabletop gamers and miniature collectors. It lets you upload compressed Archives containing your personal collection of 3D printing and tabletop files, so you can store, organize, and search your collection in one place. The Vault is permanently private: sharing features are not offered and are not planned. The Vault is not a backup service, and it does not replace your own backups.
16.1 Uploads, Formats, and Duplicates
- Only compressed Archives in ZIP, RAR, or 7Z format may be uploaded to the Vault.
- There is no per-file upload limit. Only your total Storage Limit applies.
- We detect duplicates within your own Account. If you upload an Archive with the same checksum as one already in your Vault, it is flagged as a duplicate and is not stored again, and it does not count against your Storage Limit twice. We do not compare your Archives against other users' files.
16.2 Permitted Use and Abuse
- You may store Archives containing 3D printing and tabletop collection files, and directly related materials, that you own or have the legal right to possess, whether obtained on Minarium or elsewhere.
- The Vault is not general-purpose cloud storage. Using it to store unrelated data is a violation of these Terms.
- You may not store illegal content, malware, or files you do not have the right to possess.
- Each person may have one free Vault. Creating multiple free Accounts to stack storage is prohibited.
- If we detect abuse of this section, we may suspend uploads and downloads for your Account. After notice, files may be deleted after 30 days and are then permanently deleted under the schedule in Section 16.11.
16.3 Storage Plans and Download Limits
- Free: up to 15 GB of storage and 10 GB of downloads per calendar month.
- Paid Tier 1: up to 200 GB of storage and 50 GB of downloads per calendar month.
- Paid Tier 2: up to 1 TB of storage and 250 GB of downloads per calendar month.
- Paid Tier 3: up to 3 TB of storage and 1 TB of downloads per calendar month.
Download Limits reset on the 1st of each calendar month. Unused download allowance does not roll over. Failed or interrupted downloads do not count against your Download Limit. We may apply reasonable technical rate limits to protect the stability and security of the service.
16.4 Billing and Renewal
- Paid plans are billed monthly or annually. Annual plans are priced at 11 times the monthly rate, so an annual Subscription includes one month free compared to paying monthly.
- Payments are processed by Stripe. Minarium never receives or stores your full card number. We receive only limited billing details from Stripe, such as the card brand, the last four digits, and the transaction status.
- Subscriptions renew automatically until you cancel. For annual plans, we will email you a renewal reminder at least 30 days before the renewal date. You can cancel at any time in your account settings, and cancellation takes effect at the end of your current billing period.
- Cancelling a paid Subscription does not close your Account. At the end of the billing period your Vault moves to the Free plan, and Section 16.6 applies to any files above the Free Storage Limit.
16.5 Upgrades and Downgrades
- You can upgrade at any time, and your new limits apply immediately. You are charged the price difference for the remainder of the current billing period.
- If you downgrade to a cheaper plan, or switch from an annual plan to a monthly one, the change takes effect at the end of your current billing period. You keep your current plan and its limits until then, so no refund or credit is due for the period you have already paid for.
- You can see a pending plan change, and the date it takes effect, on the Vault plans page in your account.
- Once the change takes effect, Section 16.6 applies to any files above the Storage Limit of your new plan.
16.6 Exceeding Your Storage Limit
If a downgrade or plan change leaves you storing more than your plan allows:
- New uploads are disabled until your Account is back within its Storage Limit.
- You can view and download your files, including over-limit files, during the 30-day grace period below. After that period ends, downloads are suspended until your Account is back within its Storage Limit.
- You will have 30 days from the date we notify you to delete files or upgrade your plan.
- If you are still over the limit after those 30 days, we may delete only enough files to bring your Account within its limit, starting with the most recently uploaded Archives. We will email you before any files are deleted. We will not delete your entire Vault for being over the limit.
16.7 Failed Payments
If a payment fails, we will retry it and notify you. During a 30-day grace period starting on the date of the failed payment, your Vault becomes read-only: you can view and download files, but you cannot upload. If the payment is not resolved within the 30-day grace period, your Account moves to the Free plan and Section 16.6 applies to any files above the Free Storage Limit.
16.8 Your Files, Privacy, and Our Access
- You keep all rights to the Archives you store. You grant Minarium only the limited license needed to host your Archives, make copies for storage and redundancy, back them up, deliver them to you, and process them as described in these Terms and our Privacy Policy. Storing a file in the Vault does not change the license terms attached to that file.
- Your Vault files are private by default. We do not inspect the contents of your Archives, except through automated security scanning.
- Automated scans check uploads for malware, viruses, executable files, and abuse prevention. We may quarantine, block, or remove files that fail security scanning, and we will notify you where lawful. These scans do not involve a person reviewing your files, and we do not review your files for product or marketing purposes.
- A person at Minarium may access the contents of your files only in four cases: (a) customer support you request, where access is needed to help you; (b) valid legal requests; (c) copyright investigations; or (d) investigations of suspected violations of these Terms. Human access is limited to what is necessary for that purpose and is logged.
- We may process Metadata separately from Archive contents to operate the service and to build features and dashboards for you, such as collection size, storage usage, upload counts, and file types. Metadata is used to build features for you alone. We do not open or analyze your Archives to identify the models inside them.
16.9 Personal Use Only; No Sharing
The Vault is your private library, permanently. You may not:
- Share Vault files or download links with anyone else, or otherwise make your stored files available to any other person, including other Minarium users.
- Create or distribute public links to Vault files.
- Share your Account credentials or allow anyone else to access your Vault.
- Bypass, disable, or interfere with the technical measures we use to prevent file sharing or enforce download restrictions.
- Use bots, scripts, sync tools, third-party services, APIs, or any other automation to share or redistribute Vault files or to defeat sharing or download controls.
- Resell, rent, or sublicense your Vault storage to anyone else.
Violating this section may result in suspension or termination of your Account under Section 10, and deletion of files under Section 16.11.
16.10 Exporting Your Files
- Except as limited by Section 16.6, you can download your own Archives at any time. During an active Subscription, normal downloads count against your monthly Download Limit.
- If you close your Account in good standing, you have a 30-day Export Window starting on the date of closure. During this window you may export all of your Archives as you uploaded them, and these exports do not count against your Download Limit.
- If you reopen your Account during the Export Window and your files still exist, your Vault is restored.
- If your Account is terminated for breach of these Terms, export is at our reasonable discretion and may be refused where the files themselves are the subject of the breach (for example, infringing or illegal content) or where the law prevents it.
- We may delay export while a chargeback dispute is active, until the dispute is resolved.
- We may rate-limit export activity that harms the stability of the service, but we will not use rate limits to prevent you from completing a legitimate export of your own files within the Export Window.
16.11 File Recovery, Deletion, and Retention
- Files you delete yourself remain recoverable for 7 days. After that, they are permanently deleted under the schedule below.
- If you close your Account, your files remain available during the 30-day Export Window. When the Export Window ends, your files are queued for permanent deletion and are removed from our active systems and backups within 30 days after the window closes. This means your files are permanently deleted no later than 60 days after Account closure.
- Files deleted for exceeding a Storage Limit (Section 16.6), after a failed payment (Section 16.7), or for abuse (Section 16.2) follow the notice periods in those sections and are then permanently deleted on the same 30-day removal schedule.
- If your Account is terminated for breach, we may retain files only as long as reasonably necessary for the investigation or as required by law, and we then permanently delete them on the same schedule.
- After files are deleted, we may retain limited records (such as billing records and access logs) where the law requires it, as described in our Privacy Policy.
16.12 Availability and Backup Responsibility
Vault files are hosted in a single cloud region with redundant storage within that region. We aim for commercially reasonable uptime, but we do not offer an uptime guarantee or service level agreement. Scheduled maintenance windows and emergency outages may occur. The Vault should never be your only copy of your files: you remain responsible for maintaining your own independent backups. To the maximum extent permitted by law, Minarium is not liable for lost, corrupted, or deleted files, except where the loss is caused by our gross negligence or willful misconduct. Nothing in this section limits any rights you have that cannot be excluded under applicable law.
16.13 Service Discontinuation
If we ever discontinue the Vault, we will make commercially reasonable efforts to give you an opportunity to export your files before permanent shutdown.
17. Copyright Complaints (DMCA)
We respect intellectual property rights and respond to valid copyright notices under the Digital Millennium Copyright Act (DMCA). This applies to marketplace listings, and, where required by law, to Vault content.
To submit a copyright notice, contact our designated agent: Surge Business Law, 5335 Merle Hay Rd Ste 7, Johnston, IA 50131, Email: contact@minarium.com. Your notice must include:
- Identification of the copyrighted work you claim is infringed.
- Identification of the material you claim is infringing and where it is located.
- Your contact information (name, address, email).
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act for the owner.
- Your physical or electronic signature.
If your content is removed and you believe this was a mistake, you may submit a counter-notice to the same agent with your contact information, identification of the removed material, a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification, consent to the jurisdiction of the federal court in your district (or Iowa if outside the U.S.), and your signature. We may restore the material if the complaining party does not file a court action within the statutory period.
We may terminate the Accounts of repeat infringers.
18. Artificial Intelligence (AI) Use
Minarium uses AI-powered tools to improve search, discovery, and user experience on the platform. These tools may analyze metadata, previews, or user interactions to generate better recommendations and search results.
Importantly:
- No Training on Creator Models: Minarium does not use the 3D models you upload to train our AI systems. Your designs remain your property and are not repurposed for AI training datasets.
- No Training on Vault Files: This is a permanent commitment. Minarium will never use the files you store in the Vault as AI training data. Future AI features may help organize or search your own Vault for you, but your files will never become training data, and Vault Metadata is only used to build features for you alone.
- Search & Discovery Only: Our AI systems are limited to indexing and matching models for search, discovery, and marketplace functionality.
- Transparency: Any future changes to AI use that go beyond search and discovery will be disclosed in updated Terms before implementation.
19. General Legal Provisions
19.1 Electronic Communications
You agree that we may send notices, disclosures, and other communications to you electronically, including by email to the address on your Account, and that these count as valid written notice. Keep your email address current: notices we send to the address on file are considered delivered, including deletion and renewal notices.
19.2 Service Modifications
We may add, change, or remove features of the Services. If a change materially reduces a paid Vault feature, we will give you reasonable advance notice. Discontinuation of the Vault is handled under Section 16.13.
19.3 Force Majeure
Minarium is not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters, war, terrorism, labor disputes, government actions, internet or utility failures, or failures of third-party providers.
19.4 Export Controls and Sanctions
The Services are available worldwide, except where prohibited by law. You represent that you are not located in a country subject to a comprehensive embargo, and that you are not on any government sanctions or restricted-party list. You agree to comply with applicable export control and sanctions laws.
19.5 Assignment
You may not assign or transfer these Terms or your Account. Minarium may assign these Terms in connection with a merger, acquisition, or sale of assets, and will notify you of any assignment.
19.6 Waiver
If we do not enforce a part of these Terms, that is not a waiver of our right to enforce it later.
19.7 Severability
If any part of these Terms is found unenforceable, the rest remains in effect, and the unenforceable part will be modified to the minimum extent necessary to make it enforceable.
19.8 Survival
Sections that by their nature should survive closure or termination of your Account do survive, including licenses you have granted for content already distributed, deletion and retention (Section 16.11), Disclaimers (Section 11), Limitation of Liability (Section 12), Indemnity (Section 13), Governing Law and Dispute Resolution (Section 14), and this Section 19.
